Local Self Governing Institutions and Fiscal Decentralisation in India-Form to Function

The aim of this paper is to analyse the issues and challenges linked with fiscal devolution to the local self governing institutions in India. Local self Governing Institutions in India have been playing a prominent role in implementing development programs. The 73rd amendment act and provisions of Panchayat Act (PESA) have explicitly codified the role of such institutions with regard to implementation of development programs. It is argued that local self-governing institutions on the basis of their time and place knowledge develops plans and programs based on local needs and resources and implements such plans and programs keeping the magnitude of social and political marginalization in mind. Devolution of powers to PRIs in India in last two decades receives widespread importance because of increasing role played by such Institutions in promoting development programs. It is argued that the Local Self-Governing Institutions can become instrumental by promoting development in India, if require inter and intra institutional issues will be taken into consideration. These institutions can perform effectively if needful fiscal, political and administrative powers will be provided within an appropriate institutional framework. However, the issues related to fiscal devolution to local selfgoverning institutions assume significant considering the current development role of PRIs in India. The present paper critically examines the importance of Fiscal Decentralisation for local self-governing institutions in Indian federation and how the Fiscal Decentralisation agenda for local level governing institutions disturbed because of prevailing institutional and political compulsion. The analysis of this paper is based on secondary source of information. The paper covered three broad aspects i.e. Decentralisation and fiscal decentralisation, fiscal decentralisation to Local Self-Governing Institutions in India and issues as well as challenges for fiscal decentralisation. The paper argues that factors like weak institutional design, absence of appropriate mechanism, problem in federal structure and above all, prevailing political compulsion have disturbed the fiscal devolution agenda of local levels government in India. Seen from the State specific experiences with regard to status of fiscal devolution and recommendation of the State Finance commissions, it is suggested that policies related to the States and local governments’ financial relationship need a fresh review. The paper concludes with a broad assumption that local governments should have upper hand in designing development programs and raising revenue in keeping the available local resources in mind.

Working of Panchayats in PESA Areas of Odisha-A Study of Two Districts

This paper reviews the implementation of the Provisions of Panchayats (Extension to Scheduled Areas) Act, 1996 and its implications on the functioning of Panchayats in the tribal areas of Odisha, while examining the role of Panchayats in planning and implementation of the socioeconomic development programmes in these areas. In tribal areas the self-governing institutions otherwise known as Panchayats, have emerged as institution of promoting socio-economic development. Particularly, in the context of the enactment of the PESA Act in 1996, the functioning of the Panchayats in tribal areas in Odisha has witnessed certain institutional changes, though their implications on the political-economy of the tribals have not seen significant changes. The institutionalisation of Panchayats under the framework of the PESA Act and functioning of Gram Sabhas have created space for political inclusion but the effects of this process on social and economic inclusion of the tribals have not become a reality. Increasing incidence of corruption in the matters of beneficiary selection, dominance of the local elites in the decision making and implementation process, and above all delay in planning and implementation of various schemes and programmes have exacerbated the plight of the tribals. Such scenario has raised a question on the morale of the effective functioning of the Panchayats in the tribal areas as per the provision of the PESA Act.&nbsp;

The increasing global discourse on decentralised governance in the contemporary era of socio-economic development has attracted the attention of scholars to explore on the various aspects of such discourses. In India, decentralised self-governing institutions have been emerged as an instrument of promoting socioeconomic development and in the context of tribal areas such process has promoted the institutionalization of Panchayat as part of local self-government. Particularly in the context of the enactments of the 73rd amendment act in 1992 and the Previsions of the Panchayats (Extension to the Scheduled Areas) Act in 1996, the functioning of the Panchayats in tribal areas in Odisha has become a reality. The role the Panchayats in strengthening governance and promoting socio-development in those areas in the state has become a reality. This paper analyses the functioning of the Panchayati Raj Institutions (PRIs) in the scheduled areas in Odisha while highlighting the process of the evolution of Panchayts in these areas. In this context, we highlight the process of evolution since the pre-independence period and how the evolution has reached at the present era, while unraveling the legal provisions and institutional arrangements. Further, the paper also examines the status of the implementation of the PESA Act in the state and how the PRIs in the scheduled areas are functioning as per the provisions of this act. The paper also analyses the secondary data and field notes apart from examining the legal provisions linked with the panchayats in the state. In conclusion, the paper summarises that “the functioning of panchayats in Tribal Areas can’t be termed as a non-event. Further, these institutions can play greater role in the matters of economic development and social justice and this depends upon the extent of the devolution of power and autonomy. Constitutional provision like PESA Act can fill these gaps and effective implementation of this act may lead towards the strengthening governance and promoting healthy development in tribal areas”.
